No Waiver 

1. Failure or delay by the company to enforce compliance with the ToU does not constitute a waiver of these ToU.
2.  The express waiver by the company of any provision, condition, or requirement of these ToU shall not constitute a waiver of any future obligation to comply with such provision, condition, or requirement.
